These Terms of Service (“Terms”) govern your access to and use of Branchpost (the “Service”), operated by Branchpost (“Branchpost,” “we,” “us,” or “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Branchpost is a software-as-a-service product that connects to a GitHub repository you authorize, analyzes its public structure and existing content, and generates draft blog posts that open as pull requests for your review. The Service is provided on a credit-based subscription model, with optional one-time credit top-up packs.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Service. You authenticate via GitHub OAuth. You are responsible for the security of your GitHub account, the GitHub App installation, and any activity that occurs under your Branchpost account.
You agree to provide accurate information, to maintain its accuracy, and to notify us promptly at support@branchpost.com if you suspect unauthorized access to your account.
3. Subscriptions, credits, and billing
Paid plans are billed monthly through Stripe. By starting a paid plan you authorize us, through Stripe, to charge your payment method on a recurring basis until you cancel. Plan tiers, credit allowances, and prices are described on the pricing page and may be updated from time to time.
Monthly credits reset at the start of each billing cycle and do not roll over. Top-up credits never expire and are consumed only after your monthly credits are exhausted. Credit costs for each action (drafts, regenerations, image generation, topic suggestions) are listed on the pricing page and may change with notice.
You may cancel at any time from the Stripe billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then. Except as stated in Section 4, fees are non-refundable.
4. Refunds
Subscription fees are non-refundable except where required by law. If a generation fails for a reason on our side, the credits reserved for that generation are refunded automatically to your account. Top-up credit purchases are non-refundable once credits have been delivered to your account.
5. GitHub integration and your repository
To use the Service you grant Branchpost access to one or more GitHub repositories via our GitHub App. We use that access only to: (a) read your repository structure and existing content to inform drafts; (b) open pull requests with generated drafts; and (c) react to events you have explicitly enabled (such as webhooks for topic suggestion). We do not push to your default branch or merge pull requests on your behalf. You may revoke access at any time from your GitHub settings.
6. Your content and generated drafts
As between you and Branchpost, you own everything in your repository, including any drafts the Service generates and commits as a pull request. Once a draft is opened as a pull request on your repository, it becomes your content, subject to the license terms of that repository.
You grant Branchpost a limited, worldwide, royalty-free license to access, process, and transmit your repository content and any context you provide (publication context, topics, prompts) solely to operate, maintain, and improve the Service for you. We do not use your private repository content to train third-party models.
7. AI-generated content
Drafts are generated by third-party AI models (currently Anthropic Claude). AI output can be inaccurate, biased, or otherwise unsuitable. You are solely responsible for reviewing every draft before merging, for the accuracy of any claim made in published posts, and for compliance with applicable law and any third-party rights (including copyright). Branchpost is not a publisher of your content.
Optional AI-generated images are produced by third-party services (currently Replicate). You are responsible for ensuring your use of generated images complies with those services' terms.
8. Acceptable use
You will not, and will not attempt to:
- Use the Service to generate content that is unlawful, defamatory, harassing, or that infringes another's intellectual property or privacy rights;
- Generate content that promotes violence, child sexual abuse material, or other content prohibited by our AI providers' usage policies;
- Reverse-engineer, scrape, or otherwise extract the Service in bulk, or use it to build a competing product;
- Circumvent credit limits, plan limits, or rate limits;
- Use the Service to send unsolicited communications, spam, or malware;
- Probe, scan, or test the vulnerability of the Service except under a written security testing agreement.
9. Third-party services
The Service depends on third-party providers including GitHub, Stripe, Anthropic, Cloudflare (R2), Resend, Replicate, Unsplash, Vercel, and Upstash/QStash. Their terms govern your use of those services. We are not responsible for outages or errors caused by third-party providers.
10. Beta and experimental features
Features marked “beta,” “experimental,” or similar are provided as-is. We may change or remove beta features at any time. Beta features are not subject to any uptime or support commitment.
11. Suspension and termination
We may suspend or terminate your access if you breach these Terms, if your payment method fails, or if we determine in good faith that continued access would create a legal or security risk. You may close your account at any time by contacting us at support@branchpost.com. After termination, we will delete or anonymize your personal data on the schedule described in our Privacy Policy.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANCHPOST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD AND (B) USD $100.
14. Indemnity
You agree to indemnify and hold harmless Branchpost from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) content you publish using drafts produced by the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
15. Changes to the Service and Terms
We may modify the Service or these Terms at any time. If we make a material change, we will notify you by email or in-product notice at least 14 days before the change takes effect, unless the change is required for legal or security reasons. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Branchpost is organized, without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute not subject to arbitration or small-claims court.
